Homebuyer remedies with statutory force

The Real Estate (Regulation and Development) Act 2016, administered in this state by the Telangana RERA authority, transformed the balance between Hyderabad's homebuyers and developers. An allottee facing delay can elect between exiting with a full refund plus prescribed interest, or staying in the project and claiming interest for every month of delay — Section 18 makes this the buyer's choice, not the builder's. Structural and workmanship defects carry a five-year liability after possession, and compensation claims go before the adjudicating officer.

We file and argue complaints before TG RERA, pursue execution when developers ignore orders, and carry appeals to the Real Estate Appellate Tribunal and the Telangana High Court. What can I claim if my Hyderabad flat is delayed?
Under Section 18 you choose: exit the project with a refund of everything paid plus prescribed interest, or retain the booking and claim interest for each month of delay until possession. The right election depends on the project's health and your finances — we model both before filing.
Can I complain if the project is not registered with RERA?
Yes. Non-registration is itself a violation carrying penalties up to 10% of project cost, and the authority can still entertain allottee grievances. An unregistered project is usually a red flag that strengthens, not weakens, your case.
How long do TG RERA proceedings take?
The Act mandates disposal within 60 days; in practice contested matters take several months including pleadings and hearings. Execution against a recalcitrant developer can add time — which is why we draft for enforceability from the first filing.
What if the developer ignores the RERA order?
We pursue execution before the authority, recovery certificates enforceable as land-revenue arrears, and where warranted, complementary pressure — consumer proceedings, insolvency notices or criminal process for cheque defaults — until compliance happens.
