Is software patentable in India?

Computer programmes per se are excluded by Section 3(k), but software-implemented inventions demonstrating a technical effect or technical contribution — improved performance, novel hardware interaction, technically inventive processing — are regularly granted. The specification's framing decides the outcome, which is exactly the drafting skill you are paying for.

What is the difference between a provisional and complete specification?

A provisional secures your priority date quickly with a fuller description to follow; the complete specification with claims must be filed within 12 months or the application lapses. Provisionals are valuable for fast-moving startups — but a careless provisional can limit what the complete can later claim.

How long does it take to get a patent in India?

Conventionally 3-5 years including the examination queue. Startups and other eligible applicants using Rule 24C expedited examination have received grants in roughly 1-2 years. Either way, 'patent pending' status begins protecting your position from the filing date.

Do startups get concessions on patents?

Yes — DPIIT-recognised startups and small entities pay substantially reduced official fees (around 80% rebate), qualify for expedited examination, and can access the SIPP facilitation scheme. We structure filings to capture every concession available.
