DeccanBridge Hyderabad — Criminal Law

Anticipatory bail in Hyderabad.

If you apprehend arrest, hours matter. Senior criminal counsel who move urgent anticipatory bail applications before Hyderabad courts — available 24/7.

Protection before arrest, done at speed

Anticipatory bail — now under Section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 (the successor to Section 438 CrPC) — protects a person who apprehends arrest in a non-bailable case. The application lies before the Sessions Court in Hyderabad or the Telangana High Court, and the difference between protection and custody is usually preparation: a precise application, the FIR and case-diary position understood, and counsel who can be heard on urgent mention.

Our criminal partners handle anticipatory bail across the spectrum — matrimonial and family complaints, business and cheque disputes given criminal colour, economic offences and white-collar investigations. We also manage the aftermath: compliance with conditions, police-station appearances under Section 35(3) BNSS notices with counsel present, and regular bail strategy if the matter proceeds.

What we handle

  • Urgent applications: Anticipatory bail petitions drafted and moved on urgent mention before the Hyderabad Sessions Court or Telangana High Court — same day where the cause justifies it.
  • FIR & case assessment: Certified-copy retrieval, FIR analysis and realistic advice on exposure, sections invoked and the prosecution's likely stance.
  • Interim protection: Interim orders sought pending final hearing so no arrest occurs while the application is decided.
  • Condition management: Negotiating workable conditions — passport, travel, appearance terms — and compliance management afterwards.
  • Investigation-stage defence: Representation during questioning, Section 35(3) BNSS notice appearances and protection of statements made to police.
  • Regular bail strategy: If arrest has already occurred, immediate regular bail applications under Sections 480 and 483 BNSS with the same urgency.

Common questions

Anticipatory Bail FAQ.

What is the difference between anticipatory bail and regular bail?
Anticipatory bail (Section 482 BNSS) is sought before arrest, when you apprehend it; regular bail (Sections 480 and 483 BNSS) is sought after arrest, from custody. Anticipatory bail granted in time means you are never taken into custody at all.
How quickly can an anticipatory bail application be heard in Hyderabad?
Genuinely urgent matters can be mentioned and listed the same or next working day before the Sessions Court or the Telangana High Court. Interim protection is often granted at the first hearing while the application is finally decided.
How long does anticipatory bail protection last?
Following the Supreme Court's Constitution Bench ruling in Sushila Aggarwal, anticipatory bail is not automatically time-bound — it can continue until the end of trial unless the court specifically limits it or it is cancelled for breach of conditions.
What conditions are usually imposed?
Typical conditions include cooperating with the investigation, appearing when summoned, not influencing witnesses, and sometimes surrendering the passport or seeking permission to travel abroad. We negotiate conditions you can actually live with, and apply to modify them when circumstances change.
